Freedom of Information Act (FOIA)

The Illinois Freedom of Information Act is also known as FOIA. Under the Illinois Freedom of Information Act (5 ILCS 140), records in possession of public agencies may be accessed by the public upon written request. Pursuant to 5 ILCS 140, Section 2(c), a public record is any records, reports, forms writings, letters, memoranda, books, papers, maps, photographs, cards, tapes, recordings, electronic data processing records, recorded information and all other documentary materials, regardless of physical form or characteristics, having been prepared, or having been or being used, received, possessed, or under the control of any public body. Records that are not subject to release via the FOIA process include confidential and trade secret information.

The list of asterisked items describes types of records which will be made available immediately upon request (either via the District website or paper copy). Most of these records are immediately accessible via the District website: https://www.kenilworth38.org. With the exception of the approved meeting agenda and minutes (2013 to present), Budget Information (last 5 years), Annual audit (last 5 years), Bids and RFPs, Board presentations and other documents (2016 to present), historical salary and benefits reports, community newsletters (current and last 4 years), paper copies of these records are also immediately accessible. Note: If certified copies are requested or paper copies of the exception items above, these are not immediately available but will be provided within the statutory timeframe for response.
